Minimum wages framework

Minimum wage rates change several times a year, by state, by scheduled employment, by skill category and by zone. This page explains how rates are fixed and revised, points you to the authority that notifies them, and includes a dated, sourced skill-wise snapshot for Shops & Commercial Establishments.

How to read the rates on this page

A single state can carry dozens of scheduled employments, each with unskilled / semi-skilled / skilled / highly-skilled categories and two or three geographic zones — revised on a half-yearly dearness-allowance cycle. Because of that, the skill-wise table below is a dated snapshot for one employment category (Shops & Commercial Establishments or the closest equivalent), with the effective date and source shown for every state. Track notifications for anything newer.

The legal framework

Two statutes govern, depending on whether the Code on Wages is in force for the establishment.

Minimum Wages Act, 1948

  • • Applies to employments listed in the Schedule to the Act by the appropriate government.
  • • Rates fixed per Sec. 3 by the committee method or the notification method, revised at least every five years.
  • • A rate may be fixed by the hour, day, month or piece, and may include a basic rate plus a cost-of-living allowance.
  • • Sec. 12 makes payment below the notified rate an offence regardless of contract or consent.

Code on Wages, 2019 — Chapter II

  • • Universalises minimum wages to all employments, not only scheduled ones.
  • • Sec. 6–8: rates fixed by time or piece work, with skill categories, arduousness of work and geographical area as criteria.
  • • Sec. 9: the Central Government fixes a floor wage; no state minimum wage may fall below it.
  • • Sec. 8(4): normal working day of the prescribed hours, with overtime at not less than twice the normal rate (Sec. 14).
  • • Wage definition in Sec. 2(y) determines what counts toward the minimum, capping excluded allowances.

How a rate is actually built

Four variables decide the number that applies to a given worker.

Floor wage under Section 9 acts as a national base, not as the payable rate. Where a state notification is higher, the state rate prevails.
